If You are accessing and using Visa AR Manager APIs (the “Visa Product”), these Visa Product Terms apply to You: 

1.           In addition to any requirements set out in the Visa Rules in respect of the Visa Product, Documentation relating to the Visa Product includes these Visa Product Terms, the applicable Visa AR Manager Implementation Guide, the Visa AR Manager Developer Guide, the applicable Visa AR Manager Participation Agreement and such other guides and materials related to the Visa Product made available on the Developer Platform from time to time. You agree to access and use the Visa Product and any optional Visa services available through the Visa Product in accordance with the Documentation, the Visa Developer Platform Terms of Use and any other terms or agreements referred to in these Visa Product Terms.

2.           You acknowledge that you cannot access the Visa Product without executing a separate, effective participation agreement with Visa to access and use Visa AR Manager (the “Participation Agreement”).

3.           Depending on how you enroll for, access and use the Visa Product, Your intended use case for the Visa Product and Your use of any optional Visa services available through the Visa Product, in addition to the Participation Agreement, You may be required to accept other terms of use or enter into an additional agreement with Visa.

4.           Your access and use of this Visa Product is subject at all times to Your ongoing compliance with the Documentation and the Visa Developer Platform Terms of Use and these Visa Product Terms, including any additional terms or agreements as required by the Visa Developer Platform Terms of Use and these Visa Product Terms.

5.           You are responsible for ensuring the accuracy of all information provided to Visa in connection with the Visa Product at all times and shall promptly notify Visa of any changes to such information.  Visa shall not be liable for Your use of the Visa Product, including the accuracy of any information provided to Visa, incorrect formatting, or the delayed, misdirected, non-execution, or other defective processing or execution of a payment.

6.           You acknowledge and agree that to the extent permissible under applicable law, Visa does not make any representations nor provide warranties of any kind in connection with the materials, output, and all information and other materials by Visa or its Affiliates in connection with the Visa Product. Visa provides the Visa Product and the results on an “AS IS,” “AS AVAILABLE,” “WHERE IS” and “WITH ALL FAULTS” basis with no representations or warranties, express or implied, of any kind, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement. Without limiting the generality of any limitations of liabilities in any applicable documents, and to the extent permissible under applicable law, You agree that Visa is not liable to You or any third party in relation to any use of or access to the Visa Product.

7.           If You provide merchant Information and/or other Personal Information in connection with Your use of the Visa Product, You confirm that all necessary consents required under applicable data protection laws have been obtained (and You shall provide all necessary notices to the relevant parties) to share such information with Visa for Visa’s processing of the information for the purposes contemplated under these Visa Product Terms and the Documentation. Without limiting the foregoing, any Personal Information received by Visa in connection with Your use of the Visa Product will be processed in accordance with the Participation Agreement and the Visa Developer Platform Terms of Use, including the Schedule thereto.
