Visa BIN Attribute Sharing Service Product Terms

If You are a Visa Member, the following Visa Product Terms apply to You. Please request from Visa all forms, appendices and schedules references herein.

1. Your use of the Visa BIN Attribute Sharing Service APIs is subject to the applicable provisions in the Visa Rules and completion and return to Visa of Appendix 1D, an excel sheet available on the Visa BIN Attribute Sharing Service page on Visa Online, in which You need to identify the requested access level and relevant API/s. Appendix 1D is incorporated into and made part of this Agreement by reference.

2. You will pay the Visa BIN Attribute Sharing Service fees set forth in the Visa Pricing Directory, as may be updated from time to time by Visa.  Visa will invoice You via member integrated billing for API access. Details on the billing schedule are set forth on the Visa BIN Attribute Sharing page on Visa Online.

3. You must make reasonable attempts to keep the BIN Attribute data up-to-date on its system, if such data is used to influence acceptance related decisions. At minimum, You must update the BIN Attribute data at a minimum interval of every two weeks.

4. Any access to the Visa BIN Attribute Sharing Service APIs granted to You herunder may be used for Your internal business purposes only. You may not license, provide access to or otherwise make available any Visa BIN Attribute Sharing Service API results to third parties under the Agreement.

5. Any licensing of or provision of access to or other availability of the Visa BIN Attribute Sharing Service API results by You to third parties, such as merchants, requires completion of and is subject to the terms of Form 1A, 1B, and/or 1C, as applicable and available on the Visa BIN Attribute Sharing Service page on Visa Online. Please refer to the Visa BIN Attribute Sharing Service page on VOL for an overview of the different forms.

6. Visa may update or change the Visa BIN Attribute Sharing Service APIs and the Visa BIN Attributes at any time, including removal of any Visa BIN Attribute.

7. Prior to accessing this Visa Product, You must complete certain forms that You shall request from Visa (“Forms”). In addition to other suspension rights under the Agreement, Visa may immediately suspend or terminate Your access to Visa BIN Attributes and the APIs at any time if You, Sponsor Designate or any Sponsored Entity under Form 1A, 1B or 1C, if applicable, violates any obligation set forth herein or in Form 1A, 1B or 1C, to the extent applicable, or if Visa determines, in its sole discretion, that the API or Visa BIN Attributes are accessed, used or disclosed in violation of this Agreement, the Rules or any Visa Approval under Form 1A, 1B or 1C, including, without limitation:

a) Acceptance practices that result in violation of any of the Rules, including but not limited to (i) selective treatment of specific Issuers; (ii) declining certain Visa card types; and/or (iii) modifying (a) transaction currency , (b) merchant location and/or (c) VisaNet data fields;

b) Use of any Visa BIN Attribute for any purpose other than as required for the approved use case indicated in the Visa Approval in connection with Form 1A, 1B or 1C, as applicable; or

c) Disclosure of any Visa BIN Attributes or related information to any other third party, except as approved in writing by Visa.

8. PRODUCT ID DISCLAIMER

a) Some Issuers participate in Account Level Processing (ALP) that results in the product ID being defined at the account level.  However, the Full BIN List APIs do not display any account level details. Instead, the Full BIN List API call results provide account range level information only. As a result, in certain instances, the product ID associated with the ACCOUNT RANGE LEVEL INFORMATION might differ from the product ID on file with the Issuer and IS PROVIDED AS IS AND MIGHT NOT BE ACCURATE OR CURRENT.

b) The Single BIN Look-up API is capable of providing product ID details down to the account level for those issuer BINs that participate in Account Level Processing (ALP).  The API call results show the product ID that the respective issuer has provided to Visa. While Visa asks participating issuers to keep this information updated, THE PRODUCT ID DETAILS SHOWN IN THE API CALL RESULTS ARE PROVIDED AS IS AND MAY NOT BE ACCURATE OR CURRENT.

c) For clarity, the disclaimers in this Product ID Disclaimer Section highlight certain specifics and are made in addition to and not in place of the disclaimer of warrant in the Visa Rules and the Agreement.

d) If Your Territory is in the Visa Asia Pacific Region: (a) You may allow Your Controlled Subsidiaries to use the Visa BIN Attribute Sharing Service via this Agreement subject to the terms and conditions of this Agreement. If You do so, all references to Your use of the Visa BIN Attribute Sharing Service under this Agreement shall be deemed to also refer to Your participating Controlled Subsidiaries’ use of the Visa BIN Attribute Sharing Service, and You are fully responsible for its participating Your Controlled Subsidiaries’compliance with this Agreement and for all acts and omissions of Your participating Controlled Subsidiaries in connection with such use. In addition, (b) You shall not, and shall procure that Your Controlled Subsidiaries using the Visa BIN Attribute Sharing Service shall not, disclose any data obtained through the Visa BIN Attribute Sharing Service to any third party without the prior written consent of Visa. In this paragraph, “Your Controlled Subsidiary” means an entity that is controlled by You, and “controlled by” means the possession, directly or indirectly, by You of the power to direct or cause the direction of the management policies of such entity, whether through the ownership of voting securities or by contract or otherwise.
