Visa Tap Product Terms

1.  Prior to access and use of the Visa Tap SDK (“Visa Tap SDK”) pursuant to these Terms of Use, Company must have agreed and be subject to a “Visa Tap Agreement for Solution Provider” ("Tap Agreement"). In the event of a conflict between the Tap Agreement and the Terms of Use, the Terms of Use shall prevail only with respect to Your use of the Visa Tap SDK.

2.  Company may only use the Visa Tap SDK to the extent necessary to enable one or more Eligible Use Cases and in each instance, solely in accordance with the Terms of Use, Documentation, Visa Tap Framework, and Visa Tap Solution Requirements.

3.  Company Application(s) must comply with the terms and conditions for the Visa Sensory Branding Materials (or such other similar capitalized term) as defined and stated in Your Tap Agreement. The Visa Sensory Branding Materials are incorporated into these Visa Product Terms by reference.

4.  The Solution Approval process described in Section 5.4.1. of the Terms of Use is supplemented by the requirements stated in the Visa Tap Framework and Visa Tap Solution Requirements applicable to Your Eligible Use Case(s).

5.  Company must obtain Solution Approval for any Application for each Eligible Use Case.

6.  Visa may modify the Documentation for the Visa Tap SDK (including the Visa Tap Framework and Visa Tap Solution Requirements) from time to time. Modified versions become effective as of the date made available to Company by Visa through any means, including but not limited to electronic communication or publication on a website designated by Visa.  

7.  Fees for the Visa Tap SDK will be waived during the initial launch period, which length of time shall be determined at Visa’s sole discretion. After the initial launch period, fees for the Visa Tap SDK will be set forth in a Fee Schedule and subject to Section 12 of the Terms of Use.  

8.  Definitions and interpretation. 

8.1.   The following terms shall have the meanings set forth below:

8.2.   “Company” shall be understood to refer to You.

8.3.   “Eligible Use Case” means, and is limited to, the eligible uses and sub-uses of the Visa Tap SDK identified and described in the Guide and Documentation for the Visa Tap SDK.

8.4.   “Visa Tap Framework” means any “framework” Documentation designated by Visa in the Guide as applicable to an Eligible Use Case, and all updated versions thereto.  

8.5.   “Visa Tap Specifications and Use Cases Guide” or “Guide” means the “Visa Tap Specifications and Use Cases Guide, Version 1.0” and all updated versions thereto.

8.6.   “Visa Tap Solution Requirements” means any “solution requirements” Documentation designated by Visa in the Guide as applicable to an Eligible Use Case, and all updated versions thereto.

8.7.   Unless the context otherwise requires, in these Visa Product Terms words in the singular include the plural, and words in the plural include the singular.
